These Terms of Service (“Terms”) govern your access to and use of the Quizcherry mobile application for Android and iOS (the “App”) and any related websites (including quizcherry.com) and services (collectively, the “Services”).

The Services are operated by QUIZCHERRY PREPEXAM (OPC) PRIVATE LIMITED (“Quizcherry”, “we”, “us”, “our”).

By creating an account, accessing, or using the Services, you agree to be bound by these Terms and our Privacy Policy (together, the “Agreement”). If you do not agree, do not use the Services.

1) Definitions

  • Account: Your registered user account for the Services.
  • Content: All quizzes, questions, answers, explanations, text, graphics, and other materials made available through the Services.
  • Trial: The 7‑day free trial described in Section 4.
  • Introductory Offer / Micro Plan: A paid promotional plan (e.g., a 7-day micro plan) offering full Premium access, which automatically renews into a monthly Subscription, as described in Section 5.
  • Subscription / Premium: The paid monthly plan described in Section 5.
  • Daily Question Limit: The daily access limits described in Section 6.

2) Eligibility and who may use the Services

  • You must be capable of entering into a binding contract under Indian law to use the Services.
  • If you are under 18, you may use the Services only with the consent and supervision of a parent or lawful guardian, who agrees to be bound by these Terms on your behalf.
  • You agree that the information you provide is accurate and kept up to date.

3) Account registration, security, and responsibility

  • To access the Services, you must create an Account through the App (and/or any other method we may enable).
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your Account.
  • You must not impersonate any person/entity, create Accounts using false details, or share/sell/transfer your Account.
  • We may suspend or terminate your Account if we reasonably believe it is being used fraudulently, unlawfully, or in breach of these Terms.

4) Free Trial (7 days)

  • After successful Account creation, you will receive a 7-day free Trial.
  • During the Trial, you can access the App and attempt quizzes subject to the Trial Daily Question Limit described in Section 6.
  • No payment is required by Quizcherry to start the Trial.
  • The Trial begins when your click on “Start Trial” after account creation and continues for 7 consecutive 24-hour periods, ending automatically at the end of the 7th day.
  • We may limit Trials to one per person/device/email/phone number and may deny or revoke a Trial if we reasonably believe it is being abused.
  • If you do not upgrade to an Introductory Offer or Premium before the Trial ends, your access will change as described in Section 7.

5) Premium Subscription, Introductory Offers, and billing (Apple App Store / Google Play only)

  • Plans and fees: Premium Subscription plans, Introductory Offers, features, and pricing are displayed in the App at the time of purchase and may be changed from time to time as permitted by applicable law and the relevant app store’s rules.
  • Introductory Offers: We may offer a discounted Introductory Offer (e.g., a 7-day micro plan) to new or eligible users. Unless you cancel before the introductory period ends, the Introductory Offer will automatically renew into a standard recurring monthly Premium Subscription at the standard price shown at checkout.
  • Recurring billing and auto‑renewal: Premium is billed on a recurring basis and auto‑renews unless you cancel before the renewal date/time shown in your Apple/Google subscription settings.
  • Payment processing (only via app stores):
    • All payments and subscription management are processed only by Apple App Store (iOS) or Google Play(Android), as applicable.
    • Quizcherry does not offer any other payment method within the App.
    • Your purchase may be subject to additional terms of Apple or Google.
  • Managing or cancelling subscriptions: You must manage, cancel, or change your subscription or Introductory Offer through your Apple ID/Google Play subscription settings.
  • Price changes: Where required, price changes will be communicated and implemented through the applicable app store mechanisms and will apply prospectively in accordance with app store policies and applicable law.

6) Quizzes, categories, and Daily Question Limits

  • Subjects: The Services include quizzes in:
    • English
    • Science
    • General Knowledge
      and current events content as described below.
  • Not official / no affiliation: Quizcherry is not affiliated with or endorsed by UPSC, SSC, any State PSC, any bank, or any government agency. References to examinations are for educational practice only.
  • Daily Question Limits (reset daily):
    • During an active Trial: you may attempt up to 20 questions per day total across English, Science, and General Knowledge, plus a current events quiz of up to 10 questions per day
    • During an active Premium Subscription or Introductory Offer: you may attempt up to 100 questions per day total across English, Science, and General Knowledge, plus a current events quiz of up to 30 questions per day.
  • Reset time: Daily limits reset each day.
  • No carry‑forward: Unused questions do not carry forward to the next day and have no cash value.
  • Fair use and abuse prevention: We may apply reasonable technical and operational measures to prevent scraping, sharing, or abuse of the Services and Content.

7) Access restrictions when Trial/Subscription ends (including quiz history)

  • Access requires an active Trial, Introductory Offer, or an active Subscription: You may access quizzes, attempt questions, and view quiz history only while you have an active Trial, Introductory Offer or active Premium Subscription.
  • If you do not upgrade after Trial: Once your Trial ends, you will lose access to the App’s quiz Content and your quiz history/performance within the App until you purchase Introductory Offer or Premium Subscription..
  • If you cancel Subscription or Introductory Offer: If you cancel, you will retain access until the end of your then‑current paid billing period (as determined by Apple/Google). After that, access will be restricted as above.
  • Data retention: We may retain, delete, or anonymise quiz history and Account data in accordance with our Privacy Policy and applicable law. We do not guarantee availability of historical quiz data after Trial/Subscription ends.

8) Intellectual property and license

  • The Services and all Content are owned by or licensed to Quizcherry and are protected by applicable intellectual property laws.
  • Subject to your compliance with these Terms, we grant you a limited, non‑exclusive, non‑transferable, revocable license to access and use the Services for your personal, non‑commercial educational use during an active Trial, Introductory Offer, or Subscription.
  • You must not copy, reproduce, distribute, publish, transmit, sell, license, rent, or otherwise exploit Content, including via screenshots, recordings, group sharing, coaching centres, or commercial use. You must not scrape or use automated means to extract Content.

9) Acceptable use and prohibited conduct

You agree not to:

  • violate any applicable law or regulation;
  • attempt to bypass paywalls or Daily Question Limits;
  • interfere with, damage, or disrupt the Services (including by introducing malware);
  • harass, threaten, or abuse others;
  • submit false complaints or abuse customer support channels.

10) Content accuracy and no guarantee

  • Quizcherry provides the Services for practice and learning.
  • While we take reasonable steps to provide high‑quality Content, we do not warrant that Content is error‑free, complete, or current.
  • We do not guarantee any specific score, rank, selection, employment, admission, or exam outcome.

11) Service availability and changes

  • We strive to keep the Services available, but access may occasionally be interrupted due to maintenance, upgrades, technical failures, internet/network issues, or events beyond our control.
  • We may add, remove, or modify features, Content, Daily Question Limits, or the structure of quizzes at any time.

12) Cancellation and refunds

  • Cancellation: You may cancel your Subscription or Introductory Offer at any time via Apple/Google subscription settings. Cancellation stops auto‑renewal; you will continue to have access until the end of the current billing period.
  • No refunds: No refund is issued for cancellation, unused time, or lack of usage, except where required by applicable law or where Apple/Google provides a refund under their policies.
  • App store controls: For purchases through Apple/Google, refund requests and outcomes (if any) are governed by the applicable app store’s rules and processes.

13) Suspension and termination

  • We may suspend or terminate your access immediately if you breach these Terms, if we reasonably suspect fraud/abuse/unlawful activity, or if required by law.
  • If your Account is terminated due to your breach, you may lose access immediately and no refund will be provided (subject to applicable law).

14) Limitation of liability

To the maximum extent permitted under applicable law:

  • Quizcherry will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, loss of data, or business interruption.
  • Quizcherry’s total liability for claims relating to the Services will not exceed the amount paid by you for the Subscription in the one (1) month preceding the event giving rise to the claim.
  • Nothing limits liability that cannot be limited under applicable law (including fraud or wilful misconduct).

15) Indemnity

You agree to indemnify and hold harmless Quizcherry and its officers, directors, employees, and partners from claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Services, breach of these Terms, or violation of law.

16) Privacy and data protection

We process personal data in accordance with our Privacy Policy and applicable law. We also maintain a mechanism to address user questions/grievances relating to personal data processing as required under applicable law.

18) Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on the App/website and update the “Last Updated” date. Continued use after the effective date of revised Terms constitutes acceptance.

19) Force Majeure

Quizcherry will not be liable for failure or delay in performance due to causes beyond its reasonable control, including acts of God, natural disasters, war, civil unrest, pandemic/epidemic, labour disputes, government actions, telecom/network failures, power failures, platform outages (including Apple/Google services), or cyberattacks not caused by Quizcherry’s negligence.

20) Miscellaneous

  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • No waiver: Failure to enforce any right is not a waiver.
  • Assignment: You may not assign your rights; we may assign ours as part of corporate restructuring or sale.
  • Entire agreement: These Terms and the Privacy Policy form the entire agreement between you and Quizcherry regarding the Services.
